1. Who provides the service
Buskara is provided by Pura Lógica - Unipessoal, Lda., legal person no. 509772994, with registered office at Rua do Parque Tejo, 11 2625-437 Forte da Casa, contactable at info@buskara.com (hereinafter, «we» or «Buskara»).
These conditions govern access to and use of the service by anyone who creates an account (hereinafter, «customer» or «you»). By registering, you declare that you have read and accept these conditions and that you have the authority to bind the organisation you represent.
2. What the service is
Buskara is a product search and discovery service for online shops, provided on a subscription model. Depending on the plan you take out, it includes:
indexing of the shop's catalogue and answering visitors' searches;
a search layer installed on the shop through a script;
synonym, merchandising and result exclusion rules;
features assisted by language models, such as synonym suggestions and the discovery assistant;
search and conversion statistics.
What each plan includes, and the limits on requests, installs and data retention, is described on the plans page inside the panel, which forms an integral part of these conditions.
3. Account and responsibility for access
The account is created by a person, who becomes the owner, and it may have members with different roles. You are responsible for:
keeping your credentials secret and not sharing them;
making sure that whoever you invite to the account has a reason to be there;
storing the API keys in a safe place, treating them as passwords.
Anything done with your credentials or keys is considered to have been done by you. If you suspect improper access, tell us and revoke the keys in the panel.
4. Prices, billing and payment
Prices are those shown on the plans page at the time of subscription, in euros and plus VAT at the legal rate where applicable.
Payments are processed through Stripe or ifthenpay, by Multibanco, MB WAY or the other available methods. We neither receive nor store card details.
A payment is only credited when Stripe or ifthenpay confirms it. Until that happens, the order stays pending and whatever it gives access to is not granted.
Additional request packs are consumed once what the plan includes has run out, in the order in which they were bought, and they are neither refundable nor carried over to the next month when they expire.
5. Duration, changes and cancellation
The subscription renews automatically at the end of each period, unless cancelled before that date. Cancellation is done in the panel and takes effect at the end of the paid period; there is no pro rata refund for the current period.
We may change prices with 30 days' prior notice by email. If you do not agree, you can cancel before the change takes effect.
We may suspend or terminate access, with notice, in the event of non-payment, of use that breaches point 6 or of use that puts the stability of the service at risk for other customers.
6. Acceptable use
In using the service, you undertake not to:
index unlawful content, content that infringes third-party rights or that you do not have the right to process;
use the service to search for third parties' personal data without a legal basis;
circumvent the plan's limits, in particular through several accounts for the same shop;
extract, copy or resell the service, in whole or in part, or use it to build a competing service;
submit automated requests at a rate that degrades the service for others.
7. Customer data
The catalogue, the rules, the texts and your visitors' searches are yours. We process them in order to provide the service, under the terms of the privacy policy and of the processing agreement that accompanies it.
We do not use your catalogue or your visitors' searches to train models, nor to improve results for other shops.
You can export the statistics as CSV from the panel while the account is active. After cancellation, the data is deleted within the periods stated in the privacy policy.
8. Availability and support
We make every effort to keep the service continuously available, but we do not guarantee that there will be no interruptions. There may be stoppages for maintenance, which we try to announce in advance and to carry out outside peak traffic hours.
The search layer was designed to fail quietly: if the service does not respond, it switches itself off and the shop is left with the search it had before.
Support is provided by email on working days. Plans that include contracted response times state them on the plans page.
9. Intellectual property
The software, the brand, the documentation and the design of the service are ours or our licensors'. The subscription gives you a right of use that is non-exclusive, non-transferable and limited to the duration of the contract.
10. Liability
The service is provided as it stands. To the extent permitted by law, our total liability towards you, for any cause and across all claims taken together, is limited to the amount you paid us in the 12 months before the event that gave rise to it.
We are not liable for lost profits, lost sales, loss of data that you could have restored from your own catalogue, or for indirect damages.
Nothing in these conditions excludes liability that the law does not allow to be excluded, in particular for wilful misconduct or gross negligence.
11. Changes to these conditions
We may change these conditions to keep up with changes in the service or in the law. Relevant changes are communicated by email at least 30 days in advance, and the date of the last update is at the top of this page. Continuing to use the service after they come into force counts as acceptance.
12. Applicable law and dispute resolution
These conditions are governed by Portuguese law.
In the event of a consumer dispute, the consumer may turn to an alternative dispute resolution body. The up-to-date list is available on the Portuguese Consumer Portal, at www.consumidor.pt.
For all other cases, and without prejudice to any legally mandatory jurisdiction, the courts having jurisdiction over the registered office of the Service Provider shall have exclusive jurisdiction.
